The North American Free Trade Agreement (NAFTA) created special economic and trade relationships for the United States, Canada and Mexico. The TN nonimmigrant classification permits qualified Canadian and Mexican citizens to seek temporary entry into the United States to engage in business activities at a professional level.
Among the types of professionals who are eligible to seek admission as TN nonimmigrants are accountants, engineers, lawyers, pharmacists, scientists, teachers, and a host of others. You may be eligible for TN nonimmigrant status if:
- You are a citizen of Canada or Mexico,
- Your profession is one that is listed under the NAFTA agreement,
- The position in the United States requires a NAFTA professional,
- You have a prearranged full-time or part-time job with a U.S. employer (but not self-employment),
- You have the qualifications to practice in the profession in question.
The TN Visa boasts a significant advantage in terms of the speed at which it can be obtained. Additionally, it stands out as a visa category that doesn’t necessitate sponsorship or a formal petition.
Canadian citizens can obtain the visa directly at the border, adding to its convenience. Moreover, there is no cap on the number of TN visas available. Another noteworthy feature is that, unlike the H-1B and L-1 Visa categories, the TN Visa doesn’t have a maximum length of stay and allows for indefinite renewals.
